SCORE EEG EDUCATIONAL PLATFORM

Introduction

These terms and conditions govern your use of the SCORE EEG Educational Platform (EP) by Holberg EEG AS. The terms and conditions apply for anyone who is granted a license to use the EP. The terms and conditions includes our Privacy Policy as well as use of cookies. By using the EP, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this application.

Changes to the terms and conditions

Occasionally we may, at our discretion, make changes to the terms and conditions. In these cases, we’ll provide you with prominent notice as appropriate i.e. prominent notification within the EP or via e-mail. Please make sure you read the notification carefully. If you do not wish to continue to use the EP, please contact us at info@holbergeeg.com.

Intended use

The SCORE EEG Educational Platform is an educational tool that offers interactive functionality and live descriptions for health care professionals who are learning EEG and the new global reporting standard SCORE. The user can create an EEG report and a description, and compare the final report with the descriptions from an expert. The user can also browse specific findings and view real examples in the EEG reader. The EP is only intended to be used for educational and training purposes, and not in relations to real EEG production.

License to use Educational Platform

Users can get access to the EP by registering on the Holberg EEG web page, and entering an awarded scratch code. This code is available for everyone purchasing the 7th Edition of the Niedermeyer’s electroencephalography or on request to Holberg EEG. Holberg EEG reserves the right to exclude users who do not comply with our terms and conditions, or who provide incorrect information during registration. The user access is a personal registration and must not be shared with others.

Ownership

The SCORE EEG Educational Platform is developed, controlled and operated by Holberg EEG. All content on the EP is protected by copyrights. Holberg EEG AS has the sole ownership of the Educational Platform as well as any intellectual property rights in relations to it, including the registered trademark for the designation SCORE EEG.

Users may operate the software and download the final EEG report for their own personal use and educational purposes only, subject to the restrictions set out below and elsewhere in these terms and conditions.

User content

In these terms and conditions, “your user content” means material (including without limitation text, EEG reports, raw EEG’s, EEG descriptions, images, audio material, video material and audio-visual material) that you submit to the EP, for whatever purpose.

You grant Holberg EEG a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, distribute and carry out additional R&D activities based on your user content in any existing or future media. You also grant to Holberg EEG the right to sub-license these rights, and the right to bring an action for infringement of these rights.

Your user content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action either against Holberg EEG or a third party (in each case under any applicable law).

Holberg EEG reserves the right to edit or remove any material submitted to the Educational Platform, or stored on Holberg EEG servers, or hosted or published upon this platform. Holberg EEG reserves the right to ownership of all information, including but not limited to, EEG descriptions and additional data that the user enters into the Educational Platform, and to use such information for research and development purposes.

No warranties

The Educational Platform is provided “as is” without any representations or warranties, express or implied. Holberg EEG makes no representations or warranties in relation to this platform or the information and materials provided on the EP.

Without prejudice to the generality of the foregoing paragraph, Holberg EEG does not warrant that:

the platform will be constantly available, or
the information on this platform is complete, true, accurate or non-misleading.

Holberg EEG will frequently update the Educational Platform as needed, and is not responsible for any negative consequences this might have for the user. Downtime will primarily be scheduled during low activity periods and notifications about time and duration will normally be given in advance.

Liability

Holberg EEG cannot be held responsible for any defects and deficiencies in the software creating problems/issues for the end user. We will correct such defects on a regular basis based on severity. Holberg EEG cannot be held responsible for any incorrect EEG descriptions by experts, and the user should always be aware that a EEG is a visual interpretation and that variability and interpretation disagreements might occur. All patients included in the Educational Platform have given their written consent that their EEG’s and video recordings can be used for this purpose. Patient information and video recordings are anonymized to the extent possible in order to preserve patient semiology which is important for the EEG description.

Acceptable use

You must not use the EP in any way that causes, or may cause, damage to the platform or impairment of the availability or accessibility of the platform; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

Users must not:

publish material from this Educational Platform without written consent from Holberg EEG AS
sell, rent or sub-license user access to the EP
reproduce, duplicate, copy or otherwise exploit material on the EP for a commercial purpose

You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to the EP without Holberg EEG AS express written consent.

You must not use the EP for any purposes related to marketing without Holberg EEG AS express written consent.

If Holberg EEG provides you with a user ID and password to enable you to access restricted areas of the EP or other content or services, you must ensure that the user ID and password are kept confidential.

Limitations of liability

Holberg EEG will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, the Educational platform:

to the extent that the EP is provided free-of-charge, for any direct loss
for any indirect, special or consequential loss; or
for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data

These limitations of liability apply even if Holberg EEG has been expressly advised of the potential loss.

Reasonableness

By using the EP, you agree that the exclusions and limitations of liability set out in the EP disclaimer are reasonable.

If you do not think they are reasonable, you must not use the EP.

Indemnity

You hereby indemnify Holberg EEG and undertake to keep Holberg EEG indemnified against any losses, damages, costs, liabilities and expenses incurred or suffered by the user arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.

Breaches of these terms and conditions

Without prejudice to Holberg EEG’s other rights under these terms and conditions, if you breach these terms and conditions in any way, Holberg EEG may take such action as Holberg EEG deems appropriate to deal with the breach, including suspending your access to the EP, prohibiting you from accessing the EP.

Entire agreement

These terms and conditions constitute the entire agreement between you and Holberg EEG in relation to your use of the platform, and supersede all previous agreements in respect of your use of this EP.

Holberg EEG operates www.holbergeeg.com and the www.scoreEEG/academy (the "Site"). This page informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of the Site. We use your Personal Information only for providing and improving the Site and for providing user access to the Educational Platform. By using the Site, you agree to the collection and use of information in accordance with this policy.

Information collection and use

While using our Site, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally, identifiable information may include, but is not limited to your name ("Personal Information").

Log Data

Like many site operators, we collect information that your browser sends whenever you visit our Site ("Log Data").

This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics.

In addition, we use third party services such as Google Analytics that collect, monitor and analyse the collected data.

Communications

We may use your Personal Information to contact you with newsletters, marketing or

promotional materials.

Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer's hard drive. Like many sites, we use "cookies" to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Site.

Security

The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

Changes To This Privacy Policy

This Privacy Policy is effective as of 11th of April, 2017 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page. We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any

modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy. If we make any material changes to this Privacy Policy, we will notify you either through the email address you have provided us, or by placing a prominent notice on our website.
